Why Use Background Checks? Print E-mail
Written by Wayne R. Centanni

Why Use Background Checks? There are many reasons why a background check would be requested on an individual. By no means should you settle for or even rely on results from the low-budget instant online background check companies. There is no one national database for criminal and other records, and accordingly, each area of the country where an individual has resided or worked should be researched, and if possible and the budget allows, performing on-site research returns the most accurate results.

We will focus on the top four reasons that our agency handles background investigations for our clients:

Litigation Proceedings

Background investigation performed on adversarial parties is of unlimited usefulness. For example, you need to know if a plaintiff has a litigious history. Civil and federal lawsuits, as well as criminal records, may contain a variety of significant personal information. Bankruptcy filings can provide medical-related and other creditor data that could be related to prior injuries, as well as asset and liability information. A driving record will show citations and possible past accidents, reflecting a pattern of driving habits and prior injuries. Background research can be conducted on an adversarial witness to disprove credibility for impeachment purposes. Plaintiff attorneys should also conduct background research on their clients to verify stated past civil and criminal history.

Employment Screening

This would involve pre-employment checks into a prospective employee’s prior employment, financial and criminal history, as well as learning the background of present employees suspected of theft. It would especially be necessary to learn about the backgrounds of domestic help, childcare and health care providers, elderly care providers, and others who furnish services and have access to your home. Driving records and prior worker’s compensation claims should also be investigated.

Financial Background

This topic covers a variety of situations, with the most common being the location of assets. The location of assets, including real estate, automobiles, motorcycles, boats, planes, and corporate ownership, as well as employer/wage information can be used for garnishment purposes in order to satisfy a judgment, debt, support obligation, or other collection matter. Financial information would also be useful for attorneys researching community property division, as well as determining the economic viability of litigation and assessment of settlement offers. In regards to corporate acquisitions, one should first determine the economic condition of a corporation and its subsidiaries, in addition to determining the background of a potential business partner.

Domestic Issues

Performing investigations in domestic-related matters encompasses a combination of the above background checks. Before making a serious commitment, and for prenuptial agreement purposes, a discreet investigation covering an individual’s personal and/or financial background, as well as confirmation of marital and family status by a disinterested party would be beneficial. In adultery issues, background research on a spouse’s possible paramour is valuable in assisting surveillance and other infidelity confirmations. Oftentimes the results of background investigation on an ex-spouse and their possible love interest, accompanied by surveillance results, are used in child custody matters in the modification/termination of parental rights/custody.
